Frequently Asked Questions (FAQs)

The LGPD may apply to organizations that process personal data in Brazil, offer or supply goods or services to individuals located in Brazil, process personal data of individuals located in Brazil, or process personal data that was collected in Brazil.

The LGPD may apply regardless of where the organization is headquartered, the means used for processing, or where the personal data is located.

Non-compliance with the LGPD can result in fines of up to 2% of gross revenue, capped at 50 million BRL per violation. Other sanctions may include warnings, public disclosure of the infraction, blocking or erasure of personal data, suspension of certain processing activities, and partial or full prohibition of activities related to data processing.

The LGPD and GDPR share many core data protection concepts, including lawful processing, transparency, data subject rights, security obligations, accountability, oversight by a data protection authority, and rules for international data transfers.

The European Commission’s adequacy decision for Brazil states that Brazil, through the LGPD, provides a level of protection for personal data transferred from the European Union that is essentially equivalent to the protection guaranteed under the GDPR. However, organizations should not assume that GDPR compliance automatically satisfies LGPD requirements, as differences may arise in terminology, regulatory guidance, documentation, role allocation, consent requirements, data subject request processes, breach notification thresholds and procedures, and international transfer mechanisms.

On January 27, 2026, the European Commission and Brazil adopted mutual adequacy decisions for EU-Brazil data transfers. As a result, personal data can generally be transferred between the European Economic Area and Brazil without relying on Standard Contractual Clauses, Binding Corporate Rules, or another separate transfer mechanism.

This followed the European Commission’s September 2025 draft adequacy decision for Brazil, the European Data Protection Board’s review of Brazil’s data protection framework, and Brazil’s parallel adequacy assessment. VeraSafe can help organizations assess how these developments may affect international data transfers, customer contracts, and vendor agreements.

In addition, Brazil’s Digital Child and Adolescent Statute, also known as the ECA Digital, entered into force in March 2026 and introduced new obligations for digital products and services directed at, or likely to be accessed by, children and adolescents in Brazil. These developments heighten the importance of assessing practices around children and adolescents’ data, including age-assurance measures, parental supervision mechanisms, profiling, targeted features, transparency, privacy-by-design, and safeguards for online services, games, platforms, and other digital environments.
